Cannot see how or when this problem was introduced, just suddenly stopped working the other day...
Appending the final \ seems to get it fixed again.
DEPENDS_PATH := $(subst /,\,$(PATH_TO_TOP))\tools\
Please let me know if it breaks things for others.
